GENERAL CONDITIONS & PARTICIPANT REGULATIONS

Definitions
Purchase
Any product or service purchased by the Participant from the Provider.
Participant
This is any person who in any way, directly or indirectly, enters into an agreement with the Organization for his/her participation in the Events.
Event
Cycling and other sport tour(s) and side activity(s), both individually / as a group on your own occasion and in group form organized by the Organization.
Organization
RIDE-A-ROUND.cc, part of Studio MR Concepts, registered with the Chamber of Commerce under number 84388110.
Services
The facilities associated with the Purchase. attributes cq. products and services, including tickets, refreshments, vouchers, etc. discount vouchers, places to stay, roadside assistance, and so on.
General
The conditions as described in these regulations apply to all agreements (whether concluded through an intermediary or not), whereby the Organization directly or indirectly organizes an event.
By registering, the Participant unconditionally agrees to the content of these regulations.
Deviations from these conditions are only binding if and insofar as the Organization has expressly agreed to this in writing.
General terms and conditions declared applicable by third parties are expressly rejected.
Participation and registration
Participant participates in an Event voluntarily and entirely at his own risk.
Each Participant must register individually and independently. Should it happen that the Participant registers or brings another person to an Event, the Participant must explicitly inform this other person, if a minor, his or her parent/guardian, of these General Terms and Conditions in writing before participating. If Participant fails to do so, Participant will be responsible for any claim, dispute or damage arising from the participation or presence of such other person.
Registration takes place exclusively in the manner and under the conditions specified in these regulations.
Registration is only possible:
• online: via the registration form (Atleta.cc app) via the Organization website.
• on location (if announced).For an Organization Event without registration, for example a free social ride, the same conditions apply to the Participant without there actually being a registration.
If there are a limited number of tickets per day or per event. places are available, no claim can be made for any form of participation if the tickets or places are sold out.
With an online booking, the registration fee is collected immediately after registration and is reclaimed via the website / registration system by means of iDeal, Bancontact or credit card.
When registering on location, the registration fee must be paid in exact money.
Participation in an Event is only possible if the full registration amount has been received by the Organization immediately upon payment of the registration.
The following applies to the Events: There is no minimum age. Young people under the age of 18 may only participate if they have written permission from their parent/guardian and are physically accompanied by an adult during the entire Event.
Young people under the age of 18 must be registered by an adult Participant, who must have written permission from the parent/guardian for the participation, guidance and responsibility during the Event of the young person(s) under the age of 18.
If starting numbers are made available: Participant places the starting number made available by the organization, if in the form of a sign visible on his/her bicycle, if in the form of a bib number visible on his/her clothing.
If wristbands are made available: Participant must wear the wristband made available by the organization on his/her wrist in such a way that it cannot be removed without the seal or seal. break adhesive seal.
Registration for an Event is personal. The starting number (if any), wristband and registration package are not transferable.
The participant is not medically examined by the organization. Organization advises Participant to have a medical examination carried out in advance; If you have any doubts about your health, you are advised not to participate.
The Participant declares that he is aware of the fact that participation in the Event requires good health in both a psychological and physical sense, and declares that he meets this requirement and that he has sufficiently prepared himself for the Event through training and otherwise.
The participant is responsible for deciding to stop participation in the event of (extreme) circumstances or factors that could make participation more difficult.
The Organization cannot be held liable for medical consequences resulting from participation in an Event.
Purchases
A Purchase that does not have a specific date associated with it is valid for at least 30 days. If a Facility is no longer available after this 30-day period, regardless of the reason, the Provider is no longer bound to delivery.
Participant cannot derive any rights from vouchers or vouchers. discount vouchers and/or other Facilities provided by Third Parties.
A Purchase is binding. After Purchase, the Participant cannot claim a refund of (part of) the purchase amount, regardless of the circumstances.
A ticket can be transferred by the Participant to another person, only via the dashboard of the ticket system (Atleta.cc).
A ticket and/or other Purchase may not be resold in any other way other than stated in the previous paragraph of this article. If Organization notices a resold ticket and/or other Purchase, this ticket and/or Purchase will be declared invalid and no refund of (part of) the purchase amount will be made.
A 'Check-In & Go' ticket can be exchanged for another ticket using an automatically generated discount code. The discount code provides a discount equal to the original purchase price. There will never be a refund. Any other type of Purchase cannot be exchanged for another product and/or a discount code.
The information provided with Purchase, such as the tour guide, is strictly personal for the Participant and may not be shared with third parties, made public and/or used for (other) commercial purposes without the express permission of the Organization. Any form of damage - including in any case loss of income, loss of exclusivity and reduction of exploitation opportunities, decrease in (potential) reach, missed advertising revenue and research costs - will be financially reimbursed by the Participant to the Organization within fourteen (14) days after reminder.
The participant can only derive rights from a Purchase if the Organization has received the total amount of the price owed by the participant within the period set by the Organization.
If the conditions in the previous paragraph of this article are not met or not met in a timely manner, the Purchase will be canceled. The Participant cannot then assert any rights against the Organization. In that case, the Participant is nevertheless obliged to pay the agreed price to the Organization.
Organization has the right to cancel a Purchase for reasons of its own. In this case, the Participant is entitled to a refund of any price already paid, with the exception of exclusions stated in these conditions.
Price and payment
Unless expressly agreed otherwise in writing, the stated or agreed prices apply per person and include VAT.
The price is based on the prices, taxes, etc. known at the time of booking. In the event of an increase in one or more of these items, the Organization has the right to unilaterally increase the price, provided this occurs three months after the booking. to which price the participant is bound.
If the price is unilaterally increased by the Organization within three months after the booking, the Participant has the right to terminate the agreement with the Organization. In the event of such a cancellation, the Organization and the third parties involved are in no way liable to the Participant.
Organization is at all times entitled to increase the price insofar as this follows from a change in the law, such as an increase in VAT.
Gift and/or discount vouchers
Gift and/or discount vouchers are valid until the date stated on the gift and/or discount voucher. Gift and/or discount vouchers outside the date cannot be redeemed or exchanged for money.
Gift and/or discount vouchers can never be exchanged for money.
Revocation
After reservation, a binding agreement has been concluded with the Organization for the participant.
No cancellation is possible.
Regulations
Participant will comply with (legal and local) health, safety and traffic regulations.
The Participant adheres to the instructions and (user) regulations of the Organization and of third parties, including those of the catering industry, which are given or drawn up in connection with the safe or proper implementation of the agreement or agreements.
Participant has respect for others, nature and the environment and adheres to the regulations.
The participant will not throw away any waste on and around the route.
Participant is obliged to follow all instructions from police, government officials, Organization, land owners or owners of protected areas, nature reserves and third parties involved in the Event.
Participant is careful and does not take unnecessary risks.
The participant ensures his own safety and that of others.
Participant will not behave or dress in an offensive or dangerous manner.
During an Event, the Participant will not be in possession of any objects that could reasonably pose a danger or cause serious nuisance to other Participants.
The participant is extra careful in blind bends and descents, must always have the opportunity to brake (suddenly) and will always have the expectation of possible approaching and following traffic.
The participant will not cut corners and will always cycle as far as possible on the correct side of the road, as prescribed by the traffic rules.
The participant will only overtake if this does not cause any inconvenience to other (traffic) participants.
Participant and/or group that passes another Participant and/or group takes over on the left.
When overtaking, the participant maintains a width distance of at least 1.5 meters.
Participant must wait at a closed railway crossing.
Participant does not form a platoon (being more than 50 participants).
When forming groups of more than 20 participants, a distance of at least 25 meters must be created between the groups.
Cycling with more than two riders next to each other or cycling in a fan shape is not permitted.
Participant may not stay behind cars or other motorized traffic.
The participant is aware of the traffic situation and looks for a suitable place to solve any problems, such as a flat tire or taking off a raincoat. Preferably in a parking lot or on the far right of the road along the road.
The Participant is responsible for making the decision during an Event to terminate participation.
Organization may decide to set time limits and, if the time limit is not met, to remove a Participant from the event. Organization may also exclude a Participant from (continuing) participation in an Event for other reasons.
Disqualification
Participant may be excluded from (continuing to) participate in an Event if Participant
• in the opinion of the Organisation:
• has not paid the registration fee (in full);
• does not have a (correct) starting number and/or wristband;
• does not register adheres to the rules laid down in these regulations;
• violates a rule;
• behaves improperly;
• violates (traffic) rules;
• violates additional rules set by land owners;
• does not follow instructions from the police, organization or medical staff;
• has to do with with medical problems;Participant or any interested party cannot claim any compensation or refund of the registration fee by decision of the Organization, the medical staff or the police, as referred to in the previous paragraph of this article.
The route
Organization is not responsible for the Participant being unable to fully follow and/or complete (part of) the route, regardless of the reason, for example due to roadworks, error(s) in the downloaded route, (temporary) prohibition signs, out of service ferry service(s) taken, etc.
The organization is not liable for incidents and/or damage related to the route, including but not limited to obstacles, unclear crossings, and irregularities on the route.
The participant will remain on the permitted roads/paths and must check for prohibition signs while following the route.
The route is not exclusively accessible to the Participants of an Event. Participants must therefore take other traffic into account.
The participant is responsible for being able to follow the route based on the specified GPS tracks, including providing himself with his own GPS device. bicycle navigation.
Participants cannot hold the Organization liable for the fact that they are lost.
Even when directed by fellow riders, lead riders, road captains, or other individuals employed by the Organization, it remains the Participant's responsibility to adhere to traffic rules and ensure their own safety by being vigilant of traffic, obstacles, and irregularities on the route.
The Organization may decide to adjust or shorten the route, or cancel the trip entirely, if the (safety) situation makes this necessary in the opinion of the Organization.
Organization also reserves the right to change start and/or finish times and/or places.
In the event of a decision by the Organization as referred to in the previous two paragraphs of this article, a Participant or any interested parties cannot claim compensation or a refund of the registration fee.
Amenities and service
Facilities can be used once, possibly limited in the case of an event to the specific day(s) or. time(s) and/or duration of the event.
The Participant is responsible for being at designated locations during opening hours in order to use the Facility(s).
The participant is responsible for his own food and drinks during the routes.
If the Organization uses aid stations during the Event: The food and drinks at the aid station(s) are available while supplies last. The Organization does not guarantee the presence of food and drinks at the aid station(s).
The participant is obliged to dispose of his own waste correctly.
preparation, transportation and equipment
The Participant must ensure adequate preparation and sufficient physical fitness to participate in an Event. If in doubt, the Organization recommends that the Participant be coached by an expert trainer during the preparation.
Organization is not liable for physical injury sustained during or in preparation for an Event, either due to insufficient preparation of the Participant or due to the physical health of the Participant.
The participant is responsible for his own transport to and from the start and finish location.
This also applies to visitors and Participants who unsubscribe early.
Participant is in possession of a valid ID during an Event.
The participant must provide his/her own clothing, equipment and footwear for all types of weather.
Participant must wear a helmet while cycling.
Participant wears a reflective vest or reflective strips and lighting in poor visibility (fog) and bad weather (rain).
Lighting (front and rear) is mandatory on routes with tunnels and galleries.
The materials used by the Participant when participating in the trip must meet the legal requirements and may not pose a danger to the (fellow) participant(s).
The participant is responsible for his own materials and resolving any technical defects.
The Organization reserves the right to ban certain bicycles or bicycle parts. Riding in groups is prohibited when using or in the presence of: Ox head, spaghetti, attachment, triathlon or aero handlebars, Recumbent bicycle, Unicycle, Hand bike, Multi-track vehicles, Fixed wheels and bicycles with fixed gears, Tandem, Bicycle trailer, Water bottles made of non-flexible materials (such as glass, aluminum, etc.), if stored in a closed bag.
Medical care
If a Participant sustains physical injury, this will always be reported to the Organization.
A Participant may never stay alone on the route. If someone cannot continue due to, for example, an injury or exhaustion, a fellow participant is obliged to seek help and stay with the victim. The victim may not be moved without permission from emergency services if there are serious injuries.
Insurance
Participants are required to obtain liability insurance, accident insurance, and travel insurance that provide adequate coverage and cover all potential risks in order to participate in this Event. Participants are advised that standard coverage is often insufficient in many scenarios, and therefore additional insurance should be obtained.
If the Participant does not have adequate insurance, this is at his own risk and the Organization cannot be held liable.
The Organization strongly recommends taking out cancellation insurance with coverage for sports injuries.
Liability and Indemnification Organization
Accessories that the participant receives on loan from the Organization must be returned to the assigned finish location, unless otherwise agreed. If not returned and/or if damage is found upon return, the costs will be charged. replacement and/or damage at the expense and risk of the participant.
All damage, nuisance and violations caused by the participant are at the expense and risk of the participant.
The participant is personally liable for damage caused to materials rented or used by him and/or damage to (materials of) fellow participants or other third parties.
The Participant who has booked the bike tour is also jointly and severally liable for other participants who have been registered by him.
Participant is aware that participation in this Event may involve risks and dangers. These include, but are not limited to: physical injuries such as, but not limited to, injuries to the face, body and limbs, mental injuries, permanent disabilities or the inability to practice a profession.
Participant is aware of the risks and dangers, including those resulting from negligence, carelessness or inexperience of other Participants.
Participation is entirely at your own expense and risk.
The Organization is only liable for damage suffered by a Participant if that damage is the direct and exclusive result of intent or gross negligence on the part of the Organization, on the understanding that only damage for which the Organization is insured is eligible. for compensation and insofar as this damage is covered by the relevant insurance.
The routes offered by Organization have been carefully composed. However, the organization cannot be held responsible or liable for errors in the route or route description, which could occur, for example, due to changes in the cycling, walking or road network. Nor can the Organization be held responsible or liable for closures, diversions, road works and the like that require a different route than the originally indicated route or which mean that the originally indicated route cannot be followed or is difficult to follow. In these situations, the Participant cannot claim compensation or refund of the registration fee
Organization has the right to make changes to the program, route and accommodations. If for whatever reason one or more of these aspects cannot be carried out at the location or in the manner planned by the Organization, the Organization will make every effort to provide an equivalent alternative, whereby the Participant cannot claim compensation or refund of the registration fee. The additional costs (with a maximum of 10% of the total price) can be charged to the Participant by the Organization.
Organization is not liable for damage caused by the use of promotional and communication material supplied by the Participant (such as stickers, posters, flyers, etc.). The use of stickers on the bicycle is entirely at the risk and responsibility of the Participant. The organization is not liable for any (paint) damage resulting from the use of promotional material.
The liability of the Organization is in any case (but not limited to) excluded for: • damage resulting from the actions of third parties, including third parties engaged by the Organization such as suppliers, healthcare providers, tenants/tenants of parts of the route and the services provided by them persons engaged by third parties; • damage resulting from the Participant's failure to comply with instructions from officials engaged by the Organization and from failure to comply with standards of general public order, rules of the game, safety and decency; • damage resulting from loss, damage or theft of the Participant's goods brought to an Event;• (consequential) damage as a result of changes in the start and finish times of an Event;• damage in any way caused by other Participants in an Event;• damage, direct or incurred indirectly to anyone or anything, as a direct or indirect result of any defect or any quality or circumstance in, in or on any movable or immovable property of which the Organization is the holder, (leasehold) holder, tenant or owner or which is otherwise available state of the Organization;• consequential damage and indirect (business) damage on the part of a Participant.
The Organization is never liable for damage suffered by a Participant as a result of force majeure on the part of the Organization. Force majeure also means any circumstance independent of the will of the Organization, even if this was already foreseeable as a possibility when the agreement was concluded between the Organization and the Participant, which prevents the fulfillment of the agreement.
Brand expressions and corporate identity
Participants may use the brand expressions and corporate identity (logo, advertisements, basic text, etc.) of an Event for promotion and PR. It is not permitted to use the brand expressions and corporate identity for other purposes, nor to make adjustments and changes. If in doubt, Participants should contact the Organization by sending an email to mr@ridearound.cc.
Information provision
Participant is provided with information through emails and the website of the Organization.
Participants are responsible for receiving this information (using the correct email address and reading the newsletters).
Law for the protection of personal information
Organization uses the personal data of the Participant in order to properly execute the agreement. In that context, the Organization will make the personal data available to third parties involved in the execution of the agreement with the Organization.
Organization stores the personal data of the Participant and also uses it for marketing and communication purposes. If the participant does not consider this use desirable, he can request the Organization in writing to remove him from the Organization's database, which request the Organization will comply with.
The use of the Organization's address file is in accordance with the guidelines of the Dutch Data Protection Authority.
Participants agree to the possible use of his/her image in printed matter, on the internet, photo, film, video, etc. for promotional purposes of an Event or other Events organized by Studio MR Concepts, without being entitled to any compensation. These recordings can be used by the Organization in the coming years to promote Events. If a Participant objects to this, he or she must make this known before the start of an Event.
Participants agree to the Organization sharing personal data with partners of an Event for relevant e-mailings and provision of information. The participant can unsubscribe from the e-mail messages and information provision at any time by sending an unsubscribe message to mr@ridearound.cc.
Applicable law and dispute settlement
The relationship between the Participants and the Organization is exclusively governed by Dutch law.
Disputes will only be submitted to the competent court in the Netherlands, regardless of where an Event is held.
The English terms and conditions have been translated from Dutch into English via Google. In the event of disputes, the Dutch conditions prevail.
In cases not provided for in these regulations, the Organization will decide.
